    In addition, the controller is obliged to inform all recipients to whom it discloses data of any such corrections, deletions, or restrictions placed on processing the same per Art. 16, 17 Para. 1, 18 GDPR. However, this obligation does not apply if such notification is impossible or involves a disproportionate effort. Nevertheless, users have a right to information about these recipients.

Likewise, under Art. 21 GDPR, users and data subjects have the right to object to the controller’s future processing of their data pursuant to Art. 6 Para. 1 lit. f) GDPR. In particular, an objection to data processing for the purpose of direct advertising is permissible.

III. Information about the data collecting

  1. When you download, register with, or use this App, we may ask you to provide information: By which you may be personally identified, such as name, age, e-mail, body weight and height. You need to register and log in to your account to use the QUS Sports app.
  2. First time using QUS Sports, we need to collect your height, weight and exercise settings (such as: exercise goals, heart rate zones, metric settings, etc.), device position, exercise track, exercise type (walking, running, etc.), exercise duration, distance, calories, climb rate and vital data such as heart- and respiration rate. We may collect the above data in order to record your daily sport data and track to provide you with personalized sport service.
  3. Usage Detail: When you access and use the App QUS Sports, we may automatically collect certain details of your access and the use of the App, including traffic data, logs, and other communication data, based on the resources that you access and use on or through the App.
  4. Stored Information and Files. The App may also access metadata and other information associated with other files stored on your device. This may include, for example, photographs.
  5. Location Information. This App is collecting real-time information about the location of your device. If you would like to use the outdoor sports function, due to the fact that outdoor sport requires your location data as a sports path record, we will ask you if you will allow us to invoke device permissions to obtain your location data via the device GPS signal. You can modify the location settings of your device in the device settings to change the location data you provide to us; for example, you can change or disable the methods and servers used by location-based services or modify the accuracy of location data.
  6. You provide with notifications about your account, collect this data as well as publicly share your data such as heart rate, breathing rate, distance, high-speed, training-time, etc.
  7. QUS uses the information we collect and receive to fulfill the obligations outlined under the Terms of Service. For example, we use heart rate data to provide detailed workout analysis including heart rate graphing and calorie burn information.
  8. To fulfill our obligations to protect network security, ensure the normal operation of Health and secure your account, but also to improve and optimize your service experience, we may collect data about your device and how you and your device interact with QUS Sports, including device name, device model, operating system version, and other device data.

IV. Information about the data processing

Your data processed when using our website will be deleted or blocked as soon as the purpose for its storage ceases to apply, provided the deletion of the same is not in breach of any statutory storage obligations or unless otherwise stipulated below.

Server data

For technical reasons, the following data sent by your internet browser to us or to our server provider will be collected, especially to ensure a secure and stable website: These server log files record the type and version of your browser, operating system, the website from which you came (referrer URL), the webpages on our site visited, the date and time of your visit, as well as the IP address from which you visited our site.

The data thus collected will be temporarily stored, but not in association with any other of your data.

The basis for this storage is Art. 6 Para. 1 lit. f) GDPR. Our legitimate interest lies in the improvement, stability, functionality, and security of our website.

The data will be deleted within no more than seven days, unless continued storage is required for evidentiary purposes. In which case, all or part of the data will be excluded from deletion until the investigation of the relevant incident is finally resolved.

Cookies

We use cookies on our website. Cookies are small text files or other storage technologies stored on your computer by your browser. These cookies process certain specific information about you, such as your browser, location data, or IP address.

Customer account/registration

Newsletter

If you register for our free newsletter, the data requested from you for this purpose, i.e. your email address and, optionally, your name and address, will be sent to us. If you contact us via email or the contact form, the data you provide will be used for the purpose of processing your request. We must have this data in order to process and answer your inquiry; otherwise we will not be able to answer it in full or at all.

Your data will be deleted once we have fully answered your inquiry and there is no further legal obligation to store your data, such as if an order or contract resulted therefrom.

Social media links via graphics

We also integrate the following social media sites into our website. The integration takes place via a linked graphic of the respective site. The use of these graphics stored on our own servers prevents the automatic connection to the servers of these networks for their display. Only by clicking on the corresponding graphic will you be forwarded to the service of the respective social network.

Once you click, that network may record information about you and your visit to our site. It cannot be ruled out that such data will be processed in the United States.

– You may request that we delete your personal data by contacting us under support@qus-sports.com in the manner disclosed in this Privacy Notice if we have not yet provided you with a channel for the deletion of your personal data, or if we violate our agreement with you in the collection and use of your personal data, you may contact us and request the deletion in the manner disclosed in this Privacy Notice.
